Florida Appellate Court Confirms Insurer Cannot Waive Residency Requirement in Homeowners Policy [Property Insurance Law Observer Blog]

Florida’s Fourth District Court of Appeal recently clarified the enforceability of the “residence-premises” requirement in homeowners’ insurance policies. In Universal Property & Casualty Insurance Company v. Boniface Jean, the appellate court reversed a jury verdict in favor of the homeowner, holding that coverage cannot be created by waiver when the insured does not reside at the covered property.

Stephanie concentrates her practice in the area of insurance litigation, and has extensive experience handling property, casualty, and commercial general liability matters. She represents domestic and international insurance companies in a wide range of coverage disputes, from providing strategic counseling and coverage recommendations to vigorously representing clients in litigation.

Stephanie has litigated complex coverage issues including declaratory relief actions, breach of contract claims, and matters involving bad faith, fraud, or misrepresentation. Her practice encompasses all phases of litigation, including written discovery, depositions, motion practice, settlement negotiations, and trial practice in federal and state courts throughout Florida.

Beyond her professional commitments, she provides services to U.S. veterans by preparing critical documentation to support appeals for denied benefits.

After earning her B.S. in international affairs from the Florida State University, Stephanie graduated magna cum laude from St. Thomas University School of Law. During law school, Stephanie excelled as a member of the St. Thomas Law Trial Team, successfully competing in regional and national competitions, and earning the prestigious Order of the Barristers Award for excellence in oral advocacy. Additionally, Stephanie served as a judicial intern to the Honorable William Altfield of Florida’s Eleventh Judicial Circuit, assisting with legal research on substantive and procedural issues, and preparing a presentation on recent and developing case law pertaining to technology and the Fourth Amendment for the 2018 Annual Judicial Conference.
